Community of Madrid will approve its decree of tourist apartments in March

  • The Community of Madrid plans to approve in March 2019 the reform of the decree that regulates tourist apartments and the houses of tourist use in the region.
  • The new decree will fix a maximum ratio of people per accommodation and that establishes the obligation of having a certificate of suitability (certificado de idoneidad).

 

The Community of Madrid will foreseeably approve in March the reform of the decree that regulates the tourist apartments and the houses of tourist use in the region, which will fix a maximum ratio of people housed and that establishes the obligation of having a certificate of suitability (certificado de idoneidad).

The draft version of the decree has been ready since October 2018, after having received the approval of the European Commission and have incorporated some of the allegations made by the tourism sector, the City of Madrid and the College of Architects.

But, in December 2018, a Supreme Court ruling annulled two points that appeared in the draft version: -

1.       the requirement that the housing plan be signed by a competent technician, and

2.       the obligation to register in the register of companies in order to advertise the property as a holiday let.

Thus, the new decree seeks to regulate the holiday rental industry and establishes that holiday rental properties in Madrid must have a suitability certificate (certificado de idoneidad) and sets a maximum ratio of people housed based on m2 of the property.

It also includes the obligation to have a civil liability insurance (seguro de responsabilidad civil) and claims sheets (hojas de reclamaciones), which comply with a series of rules of coexistence and habitation as well as those responsible for the property to inform about the identity of the tenants to the Police.
